What New York City Building Owners need to know before taking decision

What is Local Law 33/18?

Local Law 33 of 2018 as amended requires owners of covered buildings over 25,000 gross square feet that are subject to benchmarking and comply with LL84 /133 must obtain and display energy efficiency scores and energy efficiency label and post at each public entrance, in a form and manner established by the department.

These energy efficiency scores and grades are assigned and disclosed annually in accordance with section 28-309.12.

Local Law 95 of 2019 later adjusted and changed the grades distribution.

The label includes a 1-100 ENERGY STAR ® Score and corresponding letter grade.

  • A: 85-100
  • B: 70-84
  • C: 55-69
  • D: 0-54
  • F:  for buildings that didn’t submit required benchmarking information
  • N: for buildings exempted from benchmarking or not covered by the Energy Star program

Steps to Compliance

  • Submit benchmarking data annually by May 1 of every year
  • The energy efficiency score and grade that is obtained and assigned based on the benchmarking reporting, must be disclosed and the energy efficiency grade will be made available by the NYC Department of a Buildings in form of a Building Energy Efficiency Rating label upon October 1st of every year
  • Print and display the label in a conspicuous location near each public entrance within 30 days after October 1st
  • Failure to timely display the label will result in a fine from the NYC Department of Buildings and the building will be given an “F” grade

Violations for Non-compliance

For failure to timely display the energy efficiency score and energy efficiency grade may result in DOB violation and a penalty of $1,250 per violation.
